Cancellation, Refund, and Statutory Withdrawal Policy for Struvo
Version: 1.0
Effective Date: [INSERT DATE, E.G. OCTOBER 1, 2026]
Last Updated: [INSERT DATE]
1. Scope and Overview
1.1. This Cancellation, Refund, and Statutory Withdrawal Policy (hereinafter: "Policy") sets forth terms governing subscription cancellations, fee refunds, free trial operations, and statutory consumer withdrawal rights for the Struvo platform.
1.2. The Service Provider is: [LEGAL ENTITY NAME / FULL NAME], having its registered seat at: [REGISTERED ADDRESS], Tax ID (NIP): [NIP NUMBER], email: support@struvo.pl.
1.3. Governing Language Clause: This Policy is established in the Polish language and translated into English. In the event of any discrepancies or conflicting interpretations, the Polish version shall be authoritative and governing.
2. 14-Day Free Trial Policy
2.1. Eligible new Clients may test Start, Team or Business free of charge for fourteen (14) calendar days after adding a payment card and confirming the subscription in Stripe Checkout.
2.2. Payment Card and Billing After the Trial:
- No subscription fee is charged during the trial.
- Unless the Client cancels before the trial ends, the card will automatically be charged the selected plan price plus applicable VAT for the chosen billing period. Annual plans are paid upfront for the whole year.
- To avoid the subscription charge, the Client can cancel before the trial ends through the subscription management portal available in Account Settings.
3. Subscription Cancellation
3.1. The Client may stop renewal through Account Settings or support@struvo.pl. Cancelling before the free trial ends prevents the next period’s charge. Ordinary cancellation of a paid plan takes effect at the end of the paid month or year, with access retained until then.
3.2. No refunds for voluntary non-use of a started period applies only to professional B2B, excluding protected sole traders. It does not restrict claims for non-performance, mandatory statutory rights or an agreed SLA or Enterprise offer.
3.3. Ordinary cancellation, statutory withdrawal, complaints and data deletion requests have different effects. The Operator assesses a request by its substance, not the label used by the Client.
4. Statutory Right of Withdrawal for EU Consumers and Qualifying Sole Proprietors
4.1. This Section 4 applies exclusively to:
- Consumers (natural persons acting for purposes outside their trade, business, craft, or profession);
- Qualifying Sole Proprietors who are natural persons concluding a business contract that is not of a professional nature for them under applicable EU member state laws.
4.2. 14-Day Withdrawal Period:
- Eligible individuals have the right to withdraw from the contract concluded at a distance within 14 (fourteen) days from the date of contract conclusion, without providing any reason and without incurring penalties.
- To exercise this right, you must send an unequivocal declaration of withdrawal before the expiration of the 14-day period to:
kontakt@struvo.plor by post to our registered office address. - You may use the Model Withdrawal Form attached as Schedule 1, but it is not mandatory.
4.3. Reimbursement of Payments:
- Upon valid withdrawal, the Service Provider shall reimburse all payments received from you without undue delay, and at latest within 14 (fourteen) days from the day on which we are informed of your decision.
- Reimbursement shall be carried out using the same means of payment as you used for the initial transaction, without any reimbursement fees.
4.4. Early Performance Requested by the Consumer:
- Proportional payment for performance before withdrawal is due only where statutory conditions are met, including an express request for early performance and the required information. No charge applies to the free trial. Starting an ongoing SaaS service does not itself extinguish withdrawal rights. Failure to provide proper information may extend the withdrawal period under the law.
5. Complaints and Statutory Refunds
5.1. Report incorrect charges and non-conformity to support@struvo.pl. A description and details identifying the Agreement suffice; invoice numbers, tax IDs and screenshots help if available.
5.2. The Operator responds on a durable medium within 14 calendar days. Article 7a of the Polish Consumer Rights Act governs failure to respond to a Consumer complaint.
5.3. Rights to conformity, price reduction and termination for non-conformity appear in Section 9 of the Terms. Refunds following price reduction or such termination are made without undue delay and within 14 days of the statement as required by law. Confirmed overpayments are also refunded without undue delay and a credit note is issued if required.
