Data export and switching providers
1. Retrieval options
Built-in export produces a photo archive for a project or part of it. It is not a complete organisation export. Request other data through support@struvo.pl, identifying the organisation, scope and authorised person. Do not send credentials. Support verifies authority and scope rather than accepting instructions from anyone.
Export covers Client input/output data and related metadata, particularly photos, documentation files, projects, areas, entries, work records and relationships needed to interpret them, insofar as stored in the service. Exclusions must be specific and justified by others’ rights or protected provider data, and cannot obstruct switching. Struvo source code and other clients’ data are excluded.
Files are provided in available source formats and structured data in an agreed, commonly used machine-readable format with relationship descriptions. Support confirms formats and secure transfer method before execution. Download expiring links in time; link expiry does not shorten the applicable data retrieval period.
2. Switching provider or moving on-premises
Where Struvo is a data processing service covered by Chapter VI of Regulation (EU) 2023/2854 (Data Act), the following applies. Contract terms cannot restrict mandatory duties under that Regulation.
- Clients may request switching to another provider, moving on-premises or erasure. The maximum notice period initiating switching does not exceed two months.
- The standard transition lasts no more than 30 calendar days after notice. The Operator provides reasonable assistance, due care for continuity/security and information on known risks. The Client cooperates and may extend the transition once under Article 25 of the Data Act.
- Where 30 days is technically infeasible, the Operator notifies within 14 working days of the request, gives technical reasons and an alternative period of no more than seven months. Convenience or commercial reasons alone do not justify this.
- After transition, the Client has at least 30 calendar days to retrieve data. The Operator confirms the schedule and scope before erasure. These periods do not automatically run from the end of paid subscription access.
3. Charges and limitations
Until 11 January 2027, any switching charge is limited to directly related costs under the Data Act and requires prior disclosure. Switching charges are abolished from 12 January 2027. This document does not itself introduce a fee. Ordinary service fees and any other amounts require a separate lawful basis and advance information; they cannot be disguised switching obstacles.
We do not promise automatic migration to every product or recreation of proprietary Struvo functions elsewhere. The Operator fulfils applicable interoperability and interface duties under Article 30 of the Data Act. Available interfaces, formats, limitations and time estimates must be given before agreeing migration. The full technical export/interface catalogue still requires approval.
4. Erasure and statutory rights
Following retrieval and expiry of the applicable period, data is deleted at the Client’s choice under the DPA and statutory duties. Backup retention must follow the agreed annex, not merely link expiry. Consumer content-retrieval rights following termination and GDPR data-subject rights remain independent and cannot be made conditional on unlawful additional fees.
