## 1. Introduction and Parties to the Agreement

1.1. This End User License Agreement (hereinafter: **"EULA"**) constitutes a legally binding agreement between you (hereinafter: **"End User"** or **"You"**) and:
**[LEGAL ENTITY NAME / FULL NAME]**, having its registered seat at: **[REGISTERED ADDRESS: POSTAL CODE, CITY, STREET AND NUMBER]**, Tax ID (NIP): **[NIP NUMBER]**, REGON: **[REGON NUMBER]**, KRS: **[KRS NUMBER]** (hereinafter: **"Licensor"**).

1.2. By downloading, installing, accessing, or using the **Struvo / Track Your Build Mobile** application (hereinafter: **"Application"**) from the **Apple App Store** or **Google Play Store**, You acknowledge that You have read, understood, and agreed to be bound by the terms of this EULA.

1.3. **Acknowledgment Regarding Platform Operators (Apple Inc. and Google LLC)**:
The End User and Licensor acknowledge that this EULA is concluded strictly between the End User and the Licensor, and not with Apple Inc. or Google LLC. The Licensor, not Apple or Google, is solely responsible for the Application and the content thereof, subject to the limitations set forth herein.

1.4. **Governing Language Clause**: This EULA is drafted in the Polish language and translated into English. In the event of any discrepancies or inconsistencies, **the Polish version shall prevail and govern**.

## 2. Scope of License

2.1. The Licensor hereby grants You a limited, non-exclusive, non-transferable license (without the right to sub-license) to download, install, and use the Application:
- On any Apple-branded products (iPhone, iPad) that You own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, including Family Sharing and Volume Purchasing;
- On any Android-powered device that You own or control, as permitted by the Google Play Terms of Service.

2.2. The Application is licensed, not sold, to You for professional construction site management, field progress tracking, documentation photography, and synchronization with the Struvo cloud platform.

---

## 3. License Restrictions

You agree not to, and You shall not permit any third party to:
1. Decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the Application, except to the extent permitted by mandatory statutory law;
2. Rent, lease, lend, sell, redistribute, or sublicense the Application;
3. Modify, adapt, improve, enhance, or create derivative works from the Application;
4. Remove, alter, or obscure any proprietary notice (including copyright or trademark notices) of the Licensor;
5. Use the Application in violation of the Acceptable Use Policy or applicable environmental, labor, or building safety regulations.

---

## 4. Mobile Operating System Permissions

Certain core features of the Application require hardware access permissions granted by the mobile operating system:
1. **Camera Access (`NSCameraUsageDescription` / `android.permission.CAMERA`)**:
   - Used strictly to take on-site photos documenting construction progress and defect logs.
2. **Photo Library Access (`NSPhotoLibraryUsageDescription`, `NSPhotoLibraryAddUsageDescription`)**:
   - Used to select and upload previously taken construction photos from the device storage to project logs and to save exported project archives.
3. **Location Services (`NSLocationWhenInUseUsageDescription` / `ACCESS_FINE_LOCATION`, `ACCESS_COARSE_LOCATION`)**:
   - Used on a one-time basis to capture GPS coordinates tagging the geographic site location of a construction project. Continuous background location tracking is not performed.

You may adjust or revoke these permissions at any time via the device operating system privacy settings, noting that disabling permissions will disable corresponding application functionality.

---

## 5. Maintenance and Support

5.1. The Licensor is solely responsible for providing any maintenance and support services with respect to the Application, as specified in this EULA and the Terms of Service.

5.2. The End User and Licensor acknowledge that **neither Apple Inc. nor Google LLC has any obligation whatsoever to furnish any maintenance and support services with respect to the Application**.

5.3. Technical support requests may be submitted directly to: `support@struvo.pl`.

---

## 6. Liability and Statutory Rights

6.1. This EULA does not exclude liability for intentional harm, statutory conformity of digital services or content, or other non-waivable rights. Consumers and protected sole traders retain the remedies in Section 9 of the [Terms](/regulamin).

6.2. For the iOS Application, if it fails to conform to an applicable warranty, the User may notify Apple, which will refund its purchase price if one was paid. To the extent permitted by law, Apple has no further Application warranty obligations; the Licensor handles remaining claims. This does not promise Apple refunds for subscriptions purchased separately through Stripe.

6.3. AI outputs are drafts requiring review by an appropriately qualified person. They do not replace measurements, inspections or a statutory building logbook. Review duties do not exclude the Licensor’s responsibility for its own obligations. Section 8 of the Terms sets professional B2B liability limits.

---

## 7. Product Claims

The Licensor, not Apple or Google, is responsible for addressing any claims of the End User or any third party relating to the Application or the End User’s possession and/or use of that Application, including but not limited to:
1. Product liability claims;
2. Any claim that the Application fails to conform to any applicable legal or regulatory requirement;
3. Claims arising under consumer protection, privacy, or similar legislation.

---

## 8. Intellectual Property Infringement Claims

In the event of any third-party claim that the Application or the End User’s possession and use of the Application infringes that third party’s intellectual property rights, the Licensor, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

---

## 9. Legal Compliance and Export Controls

The End User represents and warrants that:
1. They are not located in a country that is subject to a U.S. Government or European Union embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country;
2. They are not listed on any U.S. Government or EU list of prohibited or restricted parties (including the OFAC Specially Designated Nationals list).

---

## 10. Third-Party Beneficiaries

For the Application obtained from the App Store, Apple Inc. and its subsidiaries are third-party beneficiaries of this EULA. Upon acceptance, they have, and are deemed to have accepted, the right to enforce it against the User. This provision does not grant such rights to Google.
